Big mistakes during custody battles

On Behalf of | Mar 22, 2024 | Child Custody

Custody conflicts can be a challenging aspect of a divorce or separation. Both parents may have strong opinions about what makes the most sense for their children, leading to heated disputes.

Common mistakes add to the tension characterizing these clashes. Knowing what errors to avoid helps ensure a smoother process for everyone.

Letting feelings take control

Emotions tend to run high during custody fights. Anger, resentment or sadness can cloud judgment, resulting in impulsive decisions that are likely counterproductive. Parents should remain calm and put personal grievances aside so they may better focus on their little one’s needs.

Disregarding the child’s wishes

As kids grow older, they develop preferences and opinions about where and with whom they want to live. Courts often consider these desires. Judges put more or less stock in what juveniles hope for depending on the child’s age and maturity level. Ignoring or dismissing this variable may leave the impression that personal wants are getting in the way of the dependent’s longings.

Speaking negatively about the other parent

Talking ill of one’s ex, especially in front of offspring, is a significant blunder. Such behavior can affect a youth’s emotional wellness and familial relationships. Courts frown on mothers and fathers who attempt to tarnish the other parent’s image.

Refusing to cooperate or compromise

The purpose of family court is to determine what works best for everyone. Not collaborating with the other party or dismissing compromises out of hand indicates an aversion to putting the child’s interests first. Demonstrating flexibility and a willingness to find common ground can positively impact custody decisions.

Ignoring court orders

Disregarding or defying official instructions may cause unintentional blowback. Counterproductive actions include not adhering to parenting time schedules and defying agreed-upon decisions. Selfish moves are bound to trigger undesirable consequences.

These are but a few examples of missteps that impact custody rulings. Steering clear of such pitfalls increases the odds of reaching happy resolutions.
