Why late summer might be a good time to tweak custody orders

With local schools resuming in mid-August, now is a good time to re-examine your child custody order to see if it continues to adequately meet your children's needs. Problems can arise when a custody order and schedule was set years ago when the kids were much younger. As they grow and develop, their needs change dramatically and often these custody arrangements need to be tweaked to reflect the current circumstances.

What often happens is that the parents informally agree on alterations to the formal schedule and operate under these new arrangements. While there isn't anything inherently wrong with this approach, it lacks the legal gravitas of a court-approved custody modification.

Here's how this scenario could cause problems for your or your child's other parent. If the two parents disagree on some aspect of the informal agreement, it is the old order that the courts or any law enforcement that might become involved would refer to when settling the dispute. That's despite both parents having agreed that the order in place no longer meets their children's needs.

It's a good idea to make these custody modifications now before the school year starts so that there will be no unnecessary disruptions to your children's routines once the school year has begun.

If you and your child's other parent can agree on the new terms, all that is needed is drafting and signing the new order, then filing it and awaiting the judge's signature.

Should you fail to reach accord on the proposed changes, a hearing will be set with the court to allow the judge to make the final determination.
