Should I try to mediate my divorce?

A scorched-earth divorce benefits no one. That's why many Seymour family law attorneys encourage their divorce clients to consider other options beside litigation.

One of those options could be mediation for many couples contemplating divorce.

With a neutral and independent mediator to guide the process, both parties can reach accord on the issues of their divorce. Many mediators are also attorneys, although some may not be. Still, these professionals have much knowledge of the laws that are germane to family law and divorce.

If you do retain a mediator, it's important to understand that the mediator is neither party's attorney. This is why it is so important that both spouses retain their own attorneys to advocate on their behalf. That lawyer can review and approve any proposed settlements.

Of course, not all couples are good candidates for mediation. For instance, if one spouse was abusive to the other during the marriage, mediation should unilaterally be off the table.

Also, mediation will not necessarily resolve all issues between the spouses. With the mediator's assistance, some or most or the matters can be determined at mediation sessions, but more contentious issues may still wind up litigated in court.

How can you determine whether or not mediation is the right course of action for you and your spouse? You will need to honestly examine your relationship and approach your ex with this proposition. It's also prudent to seek advice from a Tennessee family law attorney. A lawyer can listen to your concerns and offer a recommendation as to whether or not mediation is the best choice for you.
